Housing is a basic pillar of the welfare state, as it is a necessary condition for the development of other fundamental rights, such as privacy, education, human dignity or health. The global financial crisis of 2007 continues to have a serious impact on the citizens of our country, which is now combined with the effects arising from the COVID19 (2020-2021) and inflation (2022) crises. Indeed, the constant process of urbanization, couple with the process of emptying rural space and the lack of social and affordable housing, has contributed to making housing unaffordable in the main urban areas of our country to the less well-off families. Multilevel public housing policies, however, have been erratic in recent years without providing real alternatives to home ownership (from which young people and low-income families are excluded) or tenancy (which is not a truly desirable alternative to home ownership), while attempts to increase the stock of social and affordable housing (for example, through expropriations or penalties for owners of empty homes) have had limited success. This has led to a progressive precariousness of tenure and the increase (and, even, its promotion by public authorities) of situations of hidden homelessness, such as squatting, shared housing, overcrowding or substandardhousing, without the State Housing Law 12/2023 having implemented any structural measures to cover the existing gaps in the development of the right to decent and adequate housing, a function that corresponds to public authorities and not to private owners, which they are seeing their right to private property gradually being eroded. This article analyzes this problem and possible structural solutions to the housing problem, such as the territorial cohesion or the diversification of housing tenures.

L'habitatge és un pilar bàsic del sistema del benestar, doncs és una condició necessària per la desenvolupament d'altres drets fonamentals, com la intimitat, l'educació, la dignitat humana o la salut. La crisi financera mundial del 2007 continua tenint un greu impacte en els ciutadans del nostre país, que ara es combina amb els efectes de les crisis derivades de la COVID19 (2020-2021) i la inflació (2022). En efecte, el procés constant d'urbanització, juntament amb el procés de buidament de l'espai rural i la manca d'habitatges socials i assequibles, ha contribuït a fer que l'habitatge sigui inassequible a les principals zones urbanes del nostre país per a les famílies amb menys poder adquisitiu. Les polítiques públiques d'habitatge multinivell, però, han estat erràtiques en els darrers anys sense proveir d'alternatives reals a l'habitatge en propietat (del que estan exclosos els joves i les famílies amb menys ingressos) o en lloguer (que segueix sense ser una alternativa realment desitjada a la propietat de l'habitatge), alhora que els intents per augmentar el parc d'habitatge social i assequible (per exemple, mitjançant expropiacions o sancions als propietaris d'habitatges buits) han tingut un èxit limitat. Això ha provocat una precarització progressiva de la tinença i en l'augment (i, fins i tot, la seva promoció per parts dels poders públis) de les situacions de sensellarisme ocult, com l'okupació, l'habitatge compartit, la sobreocupació o l'infrahabitatge, sense que la Llei estatal d'habitatge 12/2023 hagi implementat cap mesura estructural per cobrir les llacunes existents en el desenvolupament del dret a un habitatge digne i adequat, funció que correspon als poder públics i no als propietaris privats, que estan veient com progressivament s'està erosionant el seu dret a la propietat privada.
